03/12/2007 - Peggy Cairnes - Question - Building Problems

A Needy Cry

We moved to Spain 9 months ago, purchased a warehouse with land in Montoro Nr Cordoba.  Commissioned a builder who wa recommended by our Estate Agents to extend, finish, swimming pool and conect us to all utilities.  Todate we have had a nightmare journey, the builder is now holding us to ransom, he is demanding another 5,000 euros for the certificate from the electrician which would enable us to go onto the electricity.  All this and we agreed in the contract to pay him payments of 1/3, 1/3 and the final payment upon completion of the house ext.  We also paid him on the 27th June 7,000 euros for the electricity connection.

As I said our lives here have been a nightmare journey, we have tried to get another electricain to check the wiring out and give us a certificate for the Sevillana but the builder who comes from a very wealthy and well known family here in Montoro is telling such appalling lies about us that no one will come to the house to help us.

We have sought legal advice but there in lies another problem we don't speak Spanish and she doesn't speak English, we don't understand the legal situation here in Spain and feel we are being left high and dry.  We have instructed our solicitor through an interpreter to file for court proceedings against the builder, but information is very light on the ground.

We came here because of my poor health, I had a very nasty accident and was told I would never walk again, I was fortunate to meet and discuss my problem with a remarkable surgeon, who operated on my back in January, we left for Spain on the 2nd March.  I am so blessed, I am now walking again with the aid of a cane but walking all the same.  My husband wanted a swimming pool built because it would aid my recovery, you should see the state of my pool, it looks unsafe, I don't think I will ever beable to swim in it.

All in all, we don't know who to turn to, or what to do, we seem to be against a rock and a hard place.  We just want what was agreed in the contract, which was translated into Spanish and signed for in our Solicitors office.  I go to sleep every night crying, this is not what we worked so long and hard for in England, this builder has blighted our dream and there just doesn't seem to be a light at the end of this crazy tunnel.

I am attaching diary notes of what has taken place since the build started for your information.  By the way our move in date was supposed to be June 5th 2007, here we are December and still not complete.

Please guide us, I pray all of Spain is not like this, because the nightmare is so devesting for us.

Thank you for your kindness in this matter and I pray we here from you with some positive information.

God Bless
